I have not read the whole thing, I have read a bit more than half. Some of the answers add context to the e-mail exchanges, though the context is sometimes inadequate, it seemed to me, to explain away the most damning allegations in the complaint. Readers with more patience may examine the document for themselves. The answer does make clear that the defense posture will be an aggressive one, denying everything in essence.
ADDENDUM: Another reader points out that McGinn's wife has filed for divorce. Assuming Florida evidence law follows the normal rules on privileges, McGinn has the right to prevent even his ex-wife from testifying in the lawsuit brought by the former graduate student, at least regarding any confidential communications or information that took place during the marriage.
ONE MORE: One reader has already asked about whether I will open comments here; I will not. This is an ongoing legal proceeding, painful for all involved, including, no doubt, the alleged victimizer. I do not want to have to try to moderate a discussion under these circumstances. The case is, of course, widely known in the profession, so I have shared the latest legal development.
